Acceptance of Terms
By downloading, installing, or using the FretFlow mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.
Description of Service
FretFlow is a guitar learning application that provides interactive chord diagrams, learning tools, and educational content to help users improve their guitar playing skills. The App offers both free and premium features.
User Accounts
- You may be required to create an account to access certain features of the App.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must provide accurate and complete information when creating your account.
- You must be at least 13 years old to use the App.
Premium Features and In-App Purchases
- The App offers premium features that require payment through Apple's In-App Purchase system.
- All purchases are processed by Apple and subject to Apple's terms and conditions.
- Premium features are unlocked immediately upon successful payment confirmation.
- You can restore previous purchases on new devices using the same Apple ID.
- Refunds are subject to Apple's refund policies and procedures.
- We reserve the right to modify premium features or pricing with reasonable notice.
Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App for any illegal or unauthorized purpose.
- Attempt to gain unauthorized access to the App or its systems.
- Interfere with or disrupt the App's functionality.
- Reverse engineer, decompile, or disassemble the App.
- Use the App to transmit harmful, offensive, or inappropriate content.
- Violate any applicable laws or regulations.
Intellectual Property
- The App and its content, including but not limited to text, graphics, images, and software, are owned by FretFlow and protected by intellectual property laws.
- You may not copy, reproduce, distribute, or create derivative works from the App's content without our express written permission.
- You retain ownership of any content you create or upload to the App.
- By using the App, you grant us a limited license to use your content for the purpose of providing the service.
Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.
Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:
- The App will be uninterrupted or error-free.
- Defects will be corrected.
- The App or the server that makes it available are free of viruses or other harmful components.
- The App will meet your specific requirements.
Limitation of Liability
To the maximum extent permitted by law, FretFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the App.
Indemnification
You agree to indemnify and hold harmless FretFlow and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or violation of these Terms.
Termination
- We may terminate or suspend your access to the App at any time, with or without cause, with or without notice.
- You may stop using the App at any time.
- Upon termination, your right to use the App will cease immediately.
- Provisions of these Terms that by their nature should survive termination shall survive.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FretFlow operates, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FretFlow regarding the use of the App.
